1. About these terms
These Terms & Conditions apply when you use the Thrill Seekers Adventures website, submit a request, purchase or reserve a Journey, Day Thrill, transfer, add-on, or other travel service, or otherwise enter into a booking with us.
“Thrill Seekers Adventures, "Thrill Seekers", ”Thrill Seekers CR", “TSA,” “we,” “us,” and “our” refer to Liam Alexander Rodriguez Caamaño, identification number 6-0391-0369 with registered address at Golfito, Puntarenas, Costa Rica, trading as Thrill Seekers Adventures. “Traveler,” “you,” and “your” refer to the person making the booking and each participant included in it. The person making a group booking confirms that they are authorized to provide the required information and accept the booking conditions on behalf of the other travelers, while each traveler remains responsible for complying with the conditions that apply to them.
These Terms should be read together with the applicable product page, quotation, payment request, booking confirmation, Cancellation / Refund Policy, Safety / Risk Information, Privacy Policy, and any provider terms clearly disclosed before payment. Mandatory consumer rights always prevail. If a specific confirmed booking term conflicts with a general term, the more specific confirmed term applies to that booking, unless prohibited by law.
By completing a payment or expressly accepting a booking, you confirm that you have had an opportunity to review the applicable terms. Use of the website alone does not create a travel contract.
2. Requests and booking confirmation
Submitting a request, selecting a date or time, receiving an automated message, or receiving a payment link does not by itself confirm availability or create a confirmed booking.
A booking becomes confirmed only when Thrill Seekers sends a written confirmation identifying the product, date or service period, travelers or group size, price, and payment status or payment requirements. Some services require provider approval, minimum participation, permits, transportation availability, or other operational checks before confirmation.
You are responsible for reviewing the confirmation promptly and notifying us of any error. Names, dates, ages, pickup details, accommodation information, and other required details must be accurate. TSA is not responsible for avoidable consequences caused by incomplete or incorrect information supplied by the traveler, except to the extent required by law.
If payment is collected but the requested service cannot be confirmed, TSA will offer an appropriate alternative, credit, or refund of the amount collected for the unavailable service. We will not substitute a materially different service without informing you.
3. Prices and payment
Prices, currency, taxes and inclusions are those displayed or confirmed for the selected product. A secure payment link may have an expiration date. If it expires, availability and price may need to be reconfirmed.
Prices are shown in the currency stated on the product page, quotation, or payment request. Before payment, the total payable amount will identify applicable taxes and mandatory charges. Optional items, tips, personal purchases, bank fees, card issuer charges, and currency-conversion differences are not included unless expressly stated.
Payment deadlines, deposits, installment schedules, accepted methods, and any non-refundable amounts will be disclosed before payment or in the booking confirmation. Failure to pay by the stated deadline may release a space or supplier hold without further obligation, after reasonable notice where practical.
Payments may be processed by third-party payment providers. Your bank or card issuer may apply exchange rates, international transaction fees, authorization holds, or other charges outside TSA’s control. Thrill Seekers Adventures will never ask you to send complete card details by email, phone or message.
If a price or description contains an obvious error, TSA may correct it before confirmation. If a material error is discovered after confirmation, we will contact you promptly and offer the lawful options available, which may include honoring the confirmed terms, proposing a corrected alternative, or canceling and refunding the affected service. TSA will not use this provision to make arbitrary post-booking price increases.
4. Product-specific conditions
Every product may have its own conditions, including cancellation cutoffs, minimum or maximum age, weight or height limits, required fitness or skills, accessibility limits, medical considerations, minimum group size, baggage restrictions, pickup zones, check-in times, required documents, weather rules, and provider waivers.
The conditions presented on the product page or clearly disclosed before payment form part of the booking. The traveler must review them before paying and must ask TSA about any unclear requirement.
For Journeys, the confirmed itinerary and Journey-specific terms govern included services, payment schedule, rooming, minimum participation, changes, insurance requirements, and cancellation terms. For Day Thrills, transfers, and add-ons, the confirmed date, time, pickup point, provider conditions, and product-specific cancellation window apply.
A third-party waiver may be required to participate in a particular activity. Such a waiver does not remove any consumer right or liability that cannot lawfully be excluded.
5. Traveler responsibilities
Travelers must:
- Provide complete, accurate, and timely booking, contact, health, accessibility, emergency-contact, insurance, and travel-document information when requested.
- Review all confirmations, meeting instructions, preparation guidance, and product-specific conditions.
- Arrive at the stated meeting point or pickup location on time and remain reachable through the contact method supplied.
- Carry valid passports, visas, permits, licenses, vaccination evidence, or other documents required for the destination or activity.
- Follow lawful safety instructions from TSA, the Thrill Leader, the provider, guides, drivers, accommodation staff, and public authorities.
- Use equipment as instructed and avoid conduct that endangers people, wildlife, property, or the operation.
- Tell TSA before booking, or as soon as reasonably possible, about any circumstance that may affect safe participation or require accommodation.
- Treat other travelers, communities, staff, and providers respectfully and comply with applicable law.
- For every multi-day Journey, obtain and maintain the travel insurance described in the Safety / Risk Information and provide the requested evidence by the stated deadline.
A traveler may be refused participation or removed from an activity when, based on a reasonable safety assessment, the traveler does not meet a disclosed requirement, is impaired by alcohol or drugs, engages in abusive or dangerous conduct, refuses safety instructions, or creates a material risk. Any refund will depend on the circumstances, recoverable supplier amounts, applicable product terms, and mandatory law.
6. Changes and service providers
TSA may act as organizer, operator, coordinator, reseller, or intermediary depending on the product. The booking confirmation will identify the service and, where material, TSA’s role. Hotels, transport companies, activity operators, guides, restaurants, and other suppliers may be independent service providers responsible for delivering their part of the booking.
Travel services are affected by weather, road conditions, closures, wildlife, government decisions, provider operations, and other changing conditions. TSA or a provider may make a reasonable change when necessary for safety, legality, availability, or proper operation. We will communicate material changes as soon as reasonably possible.
When an essential service is materially changed before it begins, TSA will offer a reasonable alternative, credit, or refund as required by the booking terms and applicable law. During an operating Journey or activity, a safe or operationally necessary itinerary change may involve a different route, timing, accommodation, activity, vehicle, or provider. We will seek a reasonably comparable solution, but exact equivalence cannot always be guaranteed.
Nothing in these Terms excludes or limits responsibility for TSA’s own fraud, willful misconduct, gross negligence, or any liability or consumer right that cannot lawfully be excluded. TSA is not responsible for losses caused solely by a traveler’s breach, an unrelated third party, or an event beyond reasonable control, except where applicable law provides otherwise.
7. Cancellations and refunds
Cancellations, amendments, no-shows, provider cancellations, weather decisions, credits, and refunds are governed by the Cancellation / Refund Policy and the product-specific conditions disclosed before payment.
A traveler cancellation must be submitted through the designated contact channel and include the booking reference. The time TSA receives the request—not the time TSA later replies—will normally determine the applicable cancellation window. TSA will acknowledge the request as soon as reasonably possible.
Refunds are limited to the amount paid for the affected service, subject to the confirmed cancellation terms, non-refundable costs clearly disclosed before payment, amounts actually recoverable from suppliers, and mandatory law. No policy removes rights that apply under consumer law.
8. Website and intellectual property
The website and its original text, brand elements, logos, graphics, layouts, videos, photographs, itineraries, downloadable materials, and other content are owned by or licensed to TSA and are protected by applicable intellectual-property law.
You may view and use the website for personal, non-commercial trip planning and booking. You may not copy, scrape, republish, sell, misrepresent, reverse engineer, interfere with, or commercially exploit the website or its content without written permission, except where the law allows.
Traveler reviews, photographs, or other materials will not be used for public marketing solely because they were submitted for operational purposes. Any marketing use requiring consent will be requested separately. If you submit content for publication, you confirm that you have the right to do so and grant TSA a non-exclusive license to use it for the purpose you approved.
Links to third-party websites are provided for convenience. TSA does not control their content, availability, security, or privacy practices.
9. Governing law and contact
These Terms and bookings made with TSA are governed by the laws of Costa Rica, without depriving a consumer of mandatory protections that may apply under the law of their country of residence or another competent jurisdiction.
Before starting formal proceedings, we encourage travelers to contact us so we can review and attempt to resolve the matter fairly. Nothing in these Terms restricts access to a competent consumer authority or court.
